Essential to Pebble Beach Co.'s proposal to sell a portion of its "entitlement water" to finance the completion of the Del Monte Forest Reclamation Project is the question of the legitimacy of the entitlement.

If there was no connection drawn between the "entitlement water" and the actual production of reclaimed water, what was the justification for the entitlement?

If the entitlement did not identify the source of the water and proof of its availability, how can it be legitimate?

If the sale of this water adds to the amount already designated as illegal by the State Water Resources Control Board, how can this be countenanced by the same board?

How can the Water Management District Board morally acquiesce in the sale of a deficient public resource only to those able to pay inflated prices to cover the costs of a private enterprise?

If the original contract with the MWD was to provide 800 acre-feet of reclaimed water, the inability of complying with the contract should be the basis for a rewrite of the contract and should allow for the recision of these water "entitlements."
